      THIS INDENTURE MADE the Seventeenth day of September in the year of our Lord One Thousand Seven Hundred and Eighty Three 17 Sept 1783 between ELISEBETH McCREARY otherwise SMITH late wife to JOHN McCREARY but before wife to THOMAS SMITH of Newberry Township in the County of York and Province of Pennsylvania and JAMES TOLLAND and ELISEBETH his wife and JOHN RICHMOND and HANNAH his wife of the one part. Witnesseth that Whereas the aforesaid THOMAS SMITH late of the Township, County and Province aforesaid died Intestate and at the time of his death was sized and deposed of certain tract _____________ or ____ of land situate lying and being in Newberry Township aforesaid, being by virtue of a warrant from the Hon __________ bearing date the Twenty First of February Anno Domi 1737 (21 Feb 1737). Granted unto a certain George Hall and Surveyed there in the Township of Sonnsborough in the county of Lancaster but since the division of counties is now in the county of York and in Newberry Township containing two hundred and forty four acres of land with allowance of six percent for Highways beginning at a black oak at corner with David Baylie's land, Thence south eighty digs Eastly one hundred and fifty tow perches, to a chestnut Oak thence south twenty digr Westley by land of Richard Fullon two hundred and ninety perches to a post, thence north seventy digr Westly one hundred a nd forty seven perches to a post in the line of Samuel Halls land thence North twenty degr Eastly two hundred and fifty six perches to the place of beginning surveyed the firs t April 1738 and returned in the surveys general office on May appeal. An Where as the aforesaid George Hall, for the consideration there in contained did grant bargain and sell and convey as by his deed on the twenty third day of Jan 1738 all his _____ and ______ of the above mentioned land for unto a certain John McNooss his heirs an d assigns forever. And Whereas the said John McNooss did on the Twenty fifth day of December 1739 Convey all his right and title of the said land for the consideration herein mentioned unto a certain Henry Moor his heirs and assigns forever. And that Whereas on the Twenty Sixth day of Augus t 1740 the said Henry Moor did for the consideration there in mentioned sell and convey all his right and title and interest of the aforesaid land unto Thomason Bowes his heirs and assigns forever. And that Whereas the said Thomas Bowes did on the Twenty Sixth day of March 1742 (26 Mar 1742) for the consideration therein mentioned did grant bargain and sell unto the aforesaid named THOMAS SMITH all his right tilt and interest of the said land and that the said THOMAS SMITH as aforesaid died intestate leaving issue thats to say THOMAS SMITH JUNIOR his son, and two daughters that's to say ELISEBETH intermarried to JAMES TOLLAND and HANNAH intermarried to JOHN RICHMOND the three children being joint heirs to their father's estate and that the said THOMAS SMITH JUNIOR hath after died leaving issue two children and also intestate, and after the two children died, and that the said lands being holy and soley vested in ELISEBETH TOLLAND, and HANNAH RICHMOND and their two husbands being joint heirs at law and that the aforesaid ELISEBETH McCREARY otherwise SMITH being yet alive and her dower as widow to the deceased yet reserved Witnesseth that the said ELISEBETH McCREARY otherwise SMITH, and JAMES TOLLAND, and ELISEBETH his wife, and JOHN RICHMOND and HANNAH his
      wife of the one part, for and in consideration of the sum of sixty pounds of good and lawful money of the State of Pennsylvania to them in hand paid by William Maulsby the receipt whereof is hereby first acknowledged. Have granted bargained and sold, and by these presents do grant bargain and sell unto the aforesaid William Maulsby and to his heirs and assigns all that tract of land already described now in tenure and possession of the said William Maulsby containing two hundred and forty four acres of land and allowance of six percent as is aforesaid for highways, be the same more or less.
